Consent for Processing of Personal Data and Public Use of Personal Information
By registering for the Intelligent Chess Challenge via this link: chess.intellias.com (hereinafter referred to as the “Tournament”), I hereby give my unconditional consent (hereinafter referred to as the “Consent”) to Intellias Global Limited, including its affiliated entities and to Intellias Global Limited’s and its affiliated entities employees, contractors (hereinafter referred to as the “Company”) to the following terms regarding the processing and use of my personal data:
1. I consent to the collection and processing of my personal data – including my full name, email address, phone number, LinkedIn profile URL, country of residence, chess rating on online platforms, and my chosen nickname – for the purpose of organizing and participating in the Tournament. This data will be used to verify my eligibility, register me as a participant, and communicate with me about Tournament-related matters. I further agree that the Company may also use my personal data to send me marketing materials about its products or services, inform me of future events, and notify me about job vacancies or career opportunities that may be of interest to me.
2. I understand and agree that the only personal data of mine that will be made public by the Company is my nickname (username) as provided in the registration form. The Company may feature this nickname in printed advertisements, brochures, marketing catalogues, media publications, on the Company’s websites, social platforms, in presentations, promotional videos, or any other promotional materials related to the Tournament or the Company’s marketing activities. No other personal data will be disclosed publicly without my explicit consent beyond this Consent.
3. I acknowledge that the Company organizing the Tournament (the “Company”) is based in Malta and, unless otherwise specified below, will act as the Data Controller for my personal data. If any affiliated entity of the Company is incorporated or registered in the same jurisdiction as my citizenship and/or place of residence, such affiliated entity shall, for the purposes of compliance with applicable data protection and privacy laws, act as the Data Controller in relation to the processing of my personal data within that jurisdiction. In the absence of such an affiliated entity, the Data Controller shall be Intellias Global Limited, located at 204A, Tower Road, Sliema, SLM 1602, Malta. The Data Controller (whether the Company itself, its local affiliate, or Intellias Global Limited) will process my personal data in accordance with the data protection and privacy laws applicable in my country of residence or citizenship; and international standards, including, but not limited to, the EU General Data Protection Regulation (GDPR).
4. I give my consent for the Company to share my personal data with its affiliated entities and contractors, employees or service providers as necessary for the above-stated purposes. I understand that some of these third-party partners may be located in countries outside of my home country (and outside the European Union, if applicable) that might not have data protection laws equivalent to those in my jurisdiction or the EU. By consenting here, I explicitly agree to the transfer of my personal data to such countries and acknowledge that data in those jurisdictions may be subject to lower privacy standards. I accept the potential risks involved in these international transfers, and I agree that the Company may transfer my data on this basis. The Company will take reasonable measures to safeguard my personal during such transfers in accordance with the applicable legislation.
5. I confirm that I am not a citizen or permanent resident of any of the following countries: the Russian Federation, the Islamic Republic of Iran, the Republic of Belarus, the Democratic People’s Republic of Korea (North Korea), or the Republic of the Union of Myanmar. I understand that individuals who are citizens of these countries are not permitted to participate in the Tournament. I acknowledge that this restriction is required for legal and regulatory compliance, and if this confirmation is found to be false, I could be deemed ineligible or disqualified from the Tournament.
6. I understand that this Consent is valid for two (2) years from the date I submit my personal data via the official online registration form. My personal data will be processed and retained by the Company for the duration of the Tournament and for up to two years thereafter, in order to fulfil the purposes described above. After this period, my personal data will be deleted or anonymized, unless I provide a new consent or the Company is legally required or has another lawful basis to retain it for a longer period.
7. I am aware that I have the right to withdraw my consent at any time, and that such withdrawal will not affect the lawfulness of any processing that occurred before the withdrawal. If I choose to withdraw my consent, the Company will stop processing my personal data for the purposes covered by this Consent (except where retention is required by law or allowed under another legal basis). I understand that withdrawing consent before the Tournament concludes may affect my ability to continue participating in the event. To withdraw consent or to exercise other data protection rights, I can contact the Company at the provided contact email or address.
8. If I choose to withdraw your consent, Company will cease any further processing of my personal data based on this Consent. However, any content or data that was created or used in accordance with clause 2 of this Consent in accordance with this Consent before withdrawal will remain valid and in use indefinitely.
9. I understand that it is crucial that the personal data I provide is correct and truthful. To this end, I bear responsibilities regarding the information submitted to Company:
a) I am responsible for ensuring that all personal data I provide is true, accurate, complete, and kept up to date at all times;
b) Company and/or its affiliated entities do not assume liability for any consequences, losses, or damages arising from false, misleading, or inaccurate personal data that I supply. Company is not obligated to verify or validate the accuracy of the personal data I submit, so the responsibility regarding this is on me to ensure its correctness.
c) In the event that any disputes or claims are caused by the provision of incorrect or false personal data, I will be solely responsible for resolving those disputes. Any such dispute, claim, or legal issue that arises due to false personal data I provided shall be addressed exclusively by me, and I agree that Company and/or its affiliated entities shall not be held liable or drawn into those matters. Any costs, liabilities, or legal obligations resulting from the submission of inaccurate personal data will be borne by me alone, and I should resolve those issues without recourse against Company and/or its affiliated entities.
10. If I am a resident of the State of California (United States), I acknowledge that the processing of my personal data is also subject to the California Consumer Privacy Act of 2018 (CCPA) and its amendments (including the California Privacy Rights Act, CPRA). I understand and acknowledge that:
a) The Company does not sell, lease, or share my personal information, as defined under the CCPA, to any third party for monetary or other valuable consideration. Any sharing of my personal data with the Company’s contractors, service providers, or affiliates is solely for the legitimate business purposes described in this Consent Form (e.g., tournament participation, marketing communications, or recruitment).
b) As a California resident, I may exercise my privacy rights under the CCPA, including the right to request information about how my data is used, request deletion of my personal data, or inquire further about data protection practices.
c) Such requests may be submitted by contacting the Company at the Company details as defined in clause 12 of this Consent:
d) The Company may require reasonable verification of my identity before responding to any CCPA-related request, in accordance with applicable law.
e) The Company will not discriminate against me in any way (such as by denying participation or benefits) for exercising my rights under the CCPA.
11. By submitting the Tournament registration form (online) and ticking the consent checkbox, I confirm that I have read and understood this Consent for Processing of Personal Data and Public Use of Personal Information and Company’s Privacy Policy. I freely and voluntarily consent to the processing and use of my personal data as described above for the stated purposes. This consent is given of my own free will, and I understand its content and implications. By agreeing and ticking the consent checkbox this consent form, I agree to release the Company and/or its affiliated entities from any liability regarding the usage of the content in accordance with this Consent.
